Los Comités Hospitalarios de Bioética (CHB) tienen la atribución de emitir sugerencias al personal de salud, ante casos clínicos difíciles que involucran problemas y/o dilemas bioéticos. A nivel mundial, y también en México, se encontró poca literatura relacionada, generando en ocasiones cierto grado de incertidumbre en los profesionales de la salud para su resolución. Objetivo: describir los motivos de presentación de casos clínicos de pacientes ante el CHB en un hospital de segundo nivel, desde junio de 2007 a junio de (...) 2018. Método: estudio observacional, descriptivo, retrospectivo y transversal; la muestra fue por conveniencia y se obtuvieron 48 registros de minutas. Resultados: el motivo de consulta más frecuente ante los CHB fue el apoyo en la decisión para la limitación del esfuerzo terapéutico, con 24 casos (50%). Se identificaron 34 dilemas bioéticos (71%) y 14 problemas bioéticos (29%). Conclusiones: ayudará a los servicios médicos tratantes a identificar e intervenir oportunamente, al basarse en situaciones previas sobre dilemas y/o problemas bioéticos. (shrink)

The reductionist view of contractual phenomenon, typical of civil codes and classical contract law, is a result of a blur that, overestimating the voluntary agreement, undervalues the exchange. Trying to show the partial and inadequate character of that vision of contract law, contextualists or relationists proposals have emerged, focusing on the defense of the relational contract model. These theories suggest relational justice as a new paradigm. It transfers the relational approach of sociology to law, and incorporates the analysis of plural (...) economic reciprocity. Relational justice is formulated as a theory of justice, whose three elements offer a new theoretical framework where balances and imbalances that have been showing the legal contractual reality through out history can be contextualized. In lieu of an abstract, here is a brief excerpt of the content:Adrian Del Caro PAUL CELAN'S UNCANNY SPEECH On October 22, 1960, Paul Celan was in Darmstadt, West Germany, to accept the prestigious Georg-Bûchner-Preis. Winners of this prize are required by custom to give a speech on some aspect of Georg Büchner's writings, and Celan followed suit with a speech entitled "Der Meridian." The speech itself, as an address given in German in Germany to German listeners, was uncanny, (...) but it was Celan's "uncanny" discourse that had earned him this prize in the first place. In his poetry die uncanny takes on a life of its own. In the Meridian speech, dimensions of the uncanny in Büchner's writings are explored for the purpose of shedding light on the artistic impulse, and on poetry in particular. The poetic of Paul Celan is difficult to define from the aggregate of his poems, and hardly transparent in the Meridian speech, either. But it is the concentration on the uncanny in "Meridian" that makes the effort worthwhile. I will use the Meridian speech, examples from German literature, and examples of Celan's poems to unpack this uncanny. "Meridian," like so many words chosen by Celan, is full. Among the things it can mean are highest point, prime of life, circle from pole to pole, and lines numbered according to degrees of longitude. We speak also of a prime meridian, namely Greenwich, having the property of a center, of a locus from which we determine our bearings. Celan the linguist and etymologist knew and considered all meanings. "Uncanny" as a translation of German das Unheimliche is not quite sufficient, but it is a good starting point. German heim is English home, and unheimlich, unheimisch would be unhomely or unhomey—at least in the etymological spirit. When things are not as they are at home, they are unheimlich. Grimm's dictionary tells us that it wasn't until die end of Philosophy and Literature, © 1994, 18: 211-224 212Philosophy and Literature the eighteenth century that an emotive quality was added to this formerly cognitive adjective; it began at diis time to be associated with feelings of terror, dread, and anxiety. The Romantic Ludwig Tieck was among the first German writers to treat supernatural, uncanny themes, and as unheimlich became associated with the supernatural, it began to lose its sense of homeliness. Later on, E. T. A. Hoffmann became a master of die uncanny in his numerous weird tales. English "uncanny," which is still the best translation we have for unheimlich, experienced a similar development away from its origins in Scottish, where canny meant quiet, snug, cozy, and pleasant. The Oxford English Dictionary tells us that "supernatural, mysterious, uncomfortably strange or unfamiliar" were properties ascribed to "uncanny" after 1850. Poe's writings are uncanny in this modern sense. Freud devoted an essay to the uncanny in 1919. He made die point diat das Unheimliche is merely das Heimliche that we have repressed. Ifwe romanticize this idea, dien in the beginning all things were heimlich or homey to us, and it is only after consciousness thatwe become alienated from our home in nature, a condition which makes us feel unheimlich. Celan certainly had strong reason to focus on the earliest meaning of unheimlich, since he experienced homelessness in virtually every conceivable sense of the word, but then, so did his people, dieJews; first in their experience of the Diaspora, then in their "final" eradication during the Holocaust. The people without Boden or land became, by 1945, a people no longer of die earth. Freud linked the concept of das Unheimliche to its origin in heimlich. After exhaustively quoting the lexicologists Sanders and Grimm, Freud concluded that only Schelling had added a new dimension to das Unheimliche: "Uncanny would be everything that is supposed to remain a secret, remain concealed, but has emerged."1 This is credible enough, and fits Freud's repression theory. Freud's statement at the conclusion of the first part of his long essay would have appealed to Celan: "Heimlich is a word according to whose meaning an ambivalence develops until finally it corresponds in any uncanny way with its opposite. Critical theory must add to its agenda “disrupt[ing] the easy passage from critique [to] its neoliberal double”, Nancy Fraser recently argued. Emancipatory movements have not only been transformed by neoliberalism. They have, “unwittingly”, provided powerful “ingredients” for the transition to neoliberalism. This essay examines Axel Honneth and Nancy Fraser’s assessment of and normative proposal for addressing the paradoxes of neoliberalism. The constraints of neoliberalism, I argue, bring into focus the structural challenge of immanent critique as understood within second and third (...) generation Critical Theory. Normative ambivalence within neoliberalism, I maintain, calls for a shift in the way that critical and justificatory practices are understood within the Frankfurt School. (shrink)

Hegel’s Theory of Intelligibility picks up on recent revisionist readings of Hegel to offer a productive new interpretation of his notoriously difficult work, the Science of Logic. Rocío Zambrana transforms the revisionist tradition by distilling the theory of normativity that Hegel elaborates in the Science of Logic within the context of his signature treatment of negativity, unveiling how both features of his system of thought operate on his theory of intelligibility. Zambrana clarifies crucial features of Hegel’s theory of normativity previously (...) thought to be absent from the argument of the Science of Logic—what she calls normative precariousness and normative ambivalence. She shows that Hegel’s theory of determinacy views intelligibility as both precarious, the result of practices and institutions that gain and lose authority throughout history, and ambivalent, accommodating opposite meanings and valences even when enjoying normative authority. In this way, Zambrana shows that the Science of Logic provides the philosophical justification for the necessary historicity of intelligibility. Intervening in several recent developments in the study of Kant, Hegel, and German Idealism more broadly, this book provides a productive new understanding of the value of Hegel’s systematic ambitions. La recepción durante el siglo XXse preguntó si la filosofía nietzscheana era a-, im- o anti-política, es decir, si podía ser asimilada por la democracia, o si era antimoderna, elitista y reaccionaria. El italiano Roberto Esposito ha propuesto leerla como formando e informando el paradigma de la biopolítica. Se discuten cuatro lecturas de esa biopolítica: como formadora del paradigma de la inmunidad, como tanatopolítica, como liberal y neoliberal, y como biopolítica afirmativa.

In this paper, I aim to explore whether fitness, understood as a causal disposition, can be characterized as an emergent property of organisms, or if it is reducible to the anatomical, physiological, and environmentally relative properties that characterize them. In doing so, I refer to Jessica Wilson’s characterization of ontological emergence and examine if fitness meets her criteria for ontological emergent properties (dependence and autonomy); and, if so, to what degree (weak or strong).

The current study analyzed how trait emotional intelligence (trait EI) mediates the relationship between self-esteem and state anxiety (STAI-S) and trait anxiety (STAI-T). The sample was composed of 153 undergraduate students from the University of Cádiz, Spain (71.9% women and 28.1% men). Students completed measures of self-esteem, STAI-S, STAI-T, and trait EI. Mediation analyses were completed with three trait EI dimensions (emotional attention -EA-, emotional clarity -EC-, and mood repair -MR) as mediating variables, self-esteem as the independent variable, and STAI-S (...) and STAI-T as the dependent ones. Our results confirmed that self-esteem scores explained and predicted both, STAI-S and STAI-T values (13% for STAI-S and 21% for STAI-T). This explanatory capacity is increased by 8% when accounting for all trait EI dimensions. Considering STAI-S, the results of the direct effects showed that a decrease in their levels is predicted through the increases in the levels of both, self-esteem and MR. Regarding STAI-T, the results of the direct effects showed that a decrease in their levels is predicted, in addition to an increment of self-esteem and MR values, by an increase of EC and a decrease of EA. Conversely, indirect effects revealed that higher levels of self-esteem were associated with worse scores in EA and worse MR, which in turn would enhance both STAI-S and STAI-T levels. Moreover, regarding STAI-T higher levels of self-esteem were associated with worse scores in EA and worse EC, therefore increasing STAI-T levels. As shown, the negative association found between self-esteem and EA becomes a key element. The effect of self-esteem on EA and the influence that the latter had on EC and MR exerts an indirect mediated effect with the power to invert the influence that self-esteem wields on both types of anxiety. In this sense, the apparent protective role of self-esteem changed, turning into a risk factor that promotes higher anxiety values. (shrink)

Grounding refers to expressions that establish a connection between the ground and the content evoked by a nominal or finite clause. In this paper we report on two grammatical implementations of nominal grounding in Argentine Sign Language: pointing and placing. For pointing constructions, we also examine distal-proximal pointing and directive force. We introduce the concept of placing, in which a sign is produced at a specific meaningful location in space. Two types of placing are discussed: Placing-for-Creating, in which a new (...) meaningful location is created, and Placing-by-Recruiting, which recruits an existing meaningful location. We suggest that our analysis of pointing and placing provides an account of nominal grounding unified by general cognitive principles as described within the theory of Cognitive Grammar. Pointing is known to occur in all signed languages studied to date. Although previously undocumented, we suggest that placing is also common to many, perhaps all, signed languages. (shrink)

En efecto, mostraremos cómo esta noción se configura en Suppes (1969; 1970) desde una revisión formal de la noción de modelo en Tarski (1936), focalizando nuestro análisis en tres ejes principales: i) una crítica a la perspectiva estática del semanticismo; ii) un análisis de las condiciones restrictivas y el lenguaje para la axiomatización de (...) teorías; y iii) la revisión de las nociones de ‘sistema axiomático’, ‘sistema formal’ y ‘método axiomático’. Normativity concerns what we ought to think or do and the evaluations we make. For example, we say that we ought to think consistently, we ought to keep our promises, or that Mozart is a better composer than Salieri. Yet what philosophical moral can we draw from the apparent absence of normativity in the scientific image of the world? For scientific naturalists, the moral is that the normative must be reduced to the nonnormative, while for nonnaturalists, the moral is that (...) there must be a transcendent realm of norms. _Naturalism and Normativity_ engages with both sides of this debate. Essays explore philosophical options for understanding normativity in the space between scientific naturalism and Platonic supernaturalism. They articulate a liberal conception of philosophy that is neither reducible to the sciences nor completely independent of them—yet one that maintains the right to call itself naturalism. Contributors think in new ways about the relations among the scientific worldview, our experience of norms and values, and our movements in the space of reason. Detailed discussions include the relationship between philosophy and science, physicalism and ontological pluralism, the realm of the ordinary, objectivity and subjectivity, truth and justification, and the liberal naturalisms of Donald Davidson, John Dewey, John McDowell, and Ludwig Wittgenstein. In “Violence and Metaphysics” Jacques Derrida suggests that “the only effective position to take in order not to be enveloped by Hegel would seem to be…to consider false-infinity…irreducible.” Inversely, refuting the charge of logocentrism associated with Hegelian true infinity ( wahrhafte Unendlichkeit ) would involve showing that Hegel’s speculative logic does not establish the infinity of being exempt from the negativity of the finite. This paper takes up Derrida’s challenge, and argues that true infinity is crucial to Hegel’s understanding of (...) ideality as a question of normative authority, which does not fall prey to logocentrism. Through an exposition of the dialectic of the finite and the infinite in Hegel’s Science of Logic , I argue that true infinity is not an ontological category that eliminates division, but rather refers to the metalogical standpoint involved in a philosophical account of determinacy. Although fully achieved at the end of the Logic , the metalogical standpoint that Hegel elaborates in the Seinslogik under the banner of the true infinite already clarifies that determinacy is a product of normative authority that is itself precarious. Ensuite, il étudie la mise à jour de cette controverse par Giorgio Agamben en identifiant ses principaux enjeux théoriques et politiques. Enfin, dans la troisième section, l’article étudie le contraste entre le concept de pouvoir pastoral de Michel Foucault et la version spécifique de la sécularisation proposée par le paradigme théologico-historique.

Durante las últimas décadas, la vinculación entre las imágenes y la seguridad pública se profundizó en dimensiones impensadas. Las políticas de seguridad incorporaron sistemáticamente circuitos cerrados de televisión (CCTV) para monitoreo del espacio público entre sus tecnologías para el control social y la prevención situacional del delito. Producto de la expansión de la video-vigilancia, comenzó a crecer notablemente el interés académico por la temática, sobre todo en Europa y América del Norte. América Latina, por su parte, se ha incorporado a (...) estos debates más recientemente. El artículo propone un recorrido por los trabajos que han analizado el uso de cámaras de seguridad desde distintas perspectivas teóricas y metodológicas. Esta reconstrucción del estado del arte se organiza a partir de los aspectos de la video-vigilancia que han sido privilegiados: el diálogo teórico con nociones como el control social, el panoptismo y las biopolíticas; la efectividad en la reducción del delito; el rol en la delimitación de las ciudades y clasificación social; el marco normativo y el conflicto con ciertos derechos individuales. El objetivo es reponer los debates que surgen al interior de este eje temático y dar cuenta de algunas cuestiones aún escasamente abordadas en el ámbito de la investigación regional. (shrink)

In introducing their philosophical inspirations, they name Greta Gaard's classic piece on queering ecofeminism (18) which stimulated a body of work describing the ways that patriarchal systems of power simultaneously oppress women, the erotic, and nature (1997). Drawing upon Sprinkle's background in porn and post-porn modernist theater, Stephens' background as a queer artist with a doctorate in Performance Studies, their mutual interest in sex education, and their love for the redwoods of Santa Cruz, the pair crafted ecosexuality as a particular lens for expanding queer ecofeminist inquiry into the power of sexual liberation for ecological liberation, which they do through the creative methodologies of performance. The performance art practice that they develop has significant inspiration from the Fluxus art movement, which resisted the authority of museums to define the meaning or value of art, and encouraged the active practice and production of art throughout life.Among the inspirations they list in the introduction to Assuming the Ecosexual Position, Donna Haraway and Kim TallBear stand out. Donna Haraway's presence is felt throughout the book—as a colleague of Stephens at UC Santa Cruz, as a friend at their Wedding to the Earth, as a collaborator in the documentary Water Makes Us Wet, and ultimately, as a posthuman philosopher (Haraway 2000) who has inspired Stephens and Sprinkle to "see ecosex as a conceptual art practice and a way of thinking beyond individual identity, and even beyond human beings, to envision a larger system—an ecology of relationships" (8). The authors also express the influence of their evolving relationship with Kim TallBear, with whom Beth studied while pursuing her PhD, and who has encouraged the pair to leverage this posthuman and new materialist consciousness towards decolonial politics (TallBear 2015). The research analyzes the teledentistry service applied in health services during COVID-19, studying the quality of the teledentistry service and the level of satisfaction of patients treated with this care model. A sample of 341 patients was worked on, using the SERVQUAL model. The results showed a statistically significant relationship between quality of service in teledentistry and patient satisfaction (p<0.05), where 34.9% patients perceived low quality of service and dissatisfaction, while 33.7% were pleased with the care. We conclude that, given (...) the dental health difficulties, the population of the Peruvian central jungle is dissatisfied with the teledentistry service. (shrink)

El artículo aborda el sentido de la cuestión ética dentro del pensamiento de Foucault. En primer lugar, identificamos dos críticas dentro de su obra: al sujeto como categoría y al sujeto como producto de relaciones de poder y saber. Tales críticas operarían como condición de posibilidad de la pregunta por la ética. Posteriormente, estudiamos la genealogía de esta nueva dimensión de lo ético, analizando sus diversas configuraciones históricas. De dicho trabajo surge la necesidad de actualizar una estética de la existencia. (...) Esto último se enfrenta a partir de una reelaboración de lo que sería la pars construens de la filosofía foucaultiana, cuyo aspecto central reside en la propuesta de una ética como cuidado de la libertad. We deal with the meaning of the ethical question in Foucault's thought. We find first that he makes two criticisms: of the subject as a category, and of the subject as the outcome of relations of power and knowledge. Such criticisms relate to the ethical question as its conditions of possibility. Then, we study the genealogy of this new dimension of ethics, analyzing its different historical configurations. This work shows that it is necessary to bring about an aesthetics of existence. This is tackled starting from a reworking of the pars construens of Foucault's philosophy, whose central aspect turns about ethics conceived as care for freedom. (shrink)

En este artículo analizamos las narrativas de los grandes medios de comunicación en la actualidad, en particular, de los diarios de mayor circulación nacional: Clarín y La Nación, en sus versiones digitales. Nos centramos, específicamente, en la relación neoliberalismo – reforma laboral – representaciones mediáticas, y proponemos un análisis de las lecturas preferenciales (Hall, 1981) que destacan estos medios sobre una posible reforma laboral en Argentina, a partir de 2017. El objetivo de este estudio es indagar los mecanismos discursivos y (...) las estrategias de representación que utilizan estos medios para producir y reproducir ciertas miradas sobre la flexibilización y las reformas laborales. Los interrogantes que se plantean son: ¿Qué se visibiliza, qué se enfatiza y qué se oculta en estas narrativas mediáticas digitales cuando se informa sobre una posible reforma laboral? ¿De qué modo se buscan sentar las bases ideológicas para crear un consenso social sobre la cuestión? ¿En qué marco de significación se destaca al trabajo, la flexibilización laboral, la precariedad? ¿Cómo son representados empresarios y sindicatos? Metodológicamente, se utiliza un enfoque sociosemiótico que focaliza en el análisis de los sentidos sociales que recorren a las nociones de flexibilización laboral, reformas y precariedad, a partir de los elementos formales, de contenido y de fuentes, presentes en las noticias digitales sobre la temática. Consideramos que las representaciones privilegiadas y los sentidos sociales que los medios, sobre todo los más concentrados y con un lugar jerarquizado en la estructura mediática nacional, atribuyen a reformas laborales, conflictos, formas de flexibilización, condiciones de trabajo, resultan una variable interesante para explorar los procesos culturales de construcción del sentido común y de reproducción de estereotipos sociales, en contextos neoliberales. Some mutual funds not only apply the usual asset management and custodial fees, but also front loads and redemption fees as a kind of ‘toll charge’ payable on entering and/or leaving the fund. The aim of this work is to examine the implications of the different loads and fees applied to mutual fund investors in the Spanish market. The results show that there is a relationship between the various charges and fees. The fact that load fund companies charge higher management (...) and custody fees proves the potential of the fund companies to impose higher fees on a segment of the clientele. The investors in load funds, which tend to be large in number of shareholders and belonging to banks and savings banks, are small investors who show a low cost sensitivity. A lower level of financial sophistication may be the reason for the apparent lower price awareness. The problem is that the investors in load funds are not financially compensated for the extra cost represented by the front‐load and redemption fees. The only beneficiary seems to be the financial institution itself. On this view, the survival of load funds seems to depend on the lack of financial sophistication of their clientele, combined with market inefficiencies. It is worth asking about the ethics of a situation of market segmentation that allows managing institutions to benefit from the segment of the least sophisticated investors. (shrink)

El presente artículo aborda el análisis curricular de la Lic. en Psicología de la UAQ. Valora elementos que se consideran por parte de los organismos evaluadores y acreditadores, y se recuperan los principales que deben ser atendidos en la evaluación curricular y el rediseño de las áreas de la licenciatura. Este trabajo se centra en el papel que juega la afectividad en la conocida como transformación hermenéutica de la fenomenología llevada a cabo por el joven Martin Heidegger. Tras establecer en la introducción la estrecha vinculación que existe entre la afectividad y la facticidad, tomo como hilo conductor la noción de movilidad de la vida fáctica. En un primer momento explico la peculiar significación que adquiere este término en la filosofía del joven Heidegger. En segundo lugar me detengo a analizar (...) la doble “movilidad fundamental” del amor y el odio como la matriz intencional del curare en la interpretación heideggeriana de las Confesiones de San Agustín durante las lecciones del semestre de verano de 1921. En un tercer momento considero la doble movilidad del pathos y de la disposición afectiva en las lecciones de 1924,_ Conceptos fundamentales de la filosofía aristotélica_. Y, _finalmente_, explicito la “lógica del corazón” que subyace a la hermenéutica de la facticidad desde la confluencia de la tradición neotestamentaria del _affectus _ y la tradición griega del _pathos_. En el presente trabajo, se analizan tres noticias aparecidas en el diario “La Nación”, correspondientes a un acto encabezado por Cristina Fernández y organizado por distintas corrientes militantes kirchneristas, en conmemoración de la victoria electoral de Héctor Cámpora, el 11 de marzo de 2011. Este acto supuso el afianzamiento de la Juventud Peronista actual en la escena política (...) argentina. El objetivo del trabajo es examinar la forma en que se presenta a los jóvenes militantes kirchneristas a partir de un análisis de la transactividad para observar el rol que se les adjudica como actores sociales. Para la consecución del análisis, se utilizan principalmente las herramientas de la Lingüística Crítica, las cuales se complementarán con la Teoría de la Valoración. El Análisis Crítico del Discurso constituye el marco teórico en el cual se inscribe el proyecto. Concluiremos que si bien los militantes, en general, y los jóvenes, en particular, aparecen mayormente en el rol de agente y no de afectado, se trata de acciones secundarias, en tanto organizadores del acto; acciones que semánticamente connotan pasividad, por ejemplo, pedidos que la Presidenta debe cumplir; o acciones incluidas en el discurso referido de Cristina Fernández. This paper aims to propose an inferential and dynamic approach to understanding with models in biology. Understanding plays a central role in the practice of modeling. From its links with the other two central elements of scientific research, experimentation, and explanation, we show its epistemic relevance to the case of explanation in biology. Furthermore, by including the notion of understanding, we propose a non-referentialist perspective on scientific models, which is determined by their use.

En las últimas dos décadas ha surgido en epistemología una perspectiva que rescata la noción de _comprensión_ e intenta ponerla en el foco principal de la discusión sobre la modelización científica, al considerar que tiene un papel fundamental en la actividad del conocimiento. Desde una breve revisión de algunas ideas del pragmatismo americano y del inferencialismo de Mauricio Suárez, el objetivo de este trabajo es proponer una definición inferencial de la comprensión científica. Se afirma que la comprensión cumple un papel (...) central en la práctica de la modelización, como término de éxito cognitivo, y que puede introducirse como una noción importante para la discusión acerca de la función explicativa que tienen los modelos. El objetivo del presente artículo es presentar un enfoque sobre modelización en ciencia que permite distinguir el sistema-objetivo de los fenómenos a los cuales se dirige un modelo. Para ello nos serviremos de nuestra formulación dinámica e interactiva del razonamiento sustituto. En efecto, la perspectiva que considera la generación de hipótesis a partir de un modelo como la generación de una interacción lógica entre dos pruebas, nos permitirá formular una comprensión inferencial de los sistemas-objetivos y poder distinguirlos así de los (...) fenómenos a los cuales se dirige un modelo. De tal modo proponemos una solución al problema de targetless. (shrink)

The aim of this paper is to propose the notion of dialogical assertion as a minimal unit of knowledge in the frame of dialogical pragmatism. We argue that this minimal unity is the dialogue for the p thesis, accompanied by its game of giving and asking for reasons for a winning strategy for the proponent. Thereby, we explore the problem from the semantic framework proposed by Shahid Rahman to present a dialogical definition of that concept. Furthermore, we show how the (...) notion of proposition ceases to be the primordial logical concept and how it is replaced by the notion of assertion as an act in the process of a dialogue game and following the fundamental insights of Brandom and Martin-Löf. This pragmatic approach to logic will abandon the idea that the proposition is the minimum logical unit of true knowledge. (shrink)
